The Michigan Court of Appeals finally strikes down the Unlawful Transportation of Marijuana Statute which was enacted in 2012. It stated that medical marijuana could not be transported in the passenger compartment of a motor vehicle and must be in a locked box in the trunk. Defense attorneys have been arguing to trial courts all over the state that this law contradicts the 2008 Michigan Medical Marijuana Act. On December 20, 2016 the Court of Appeals ruled that the improper transport law contradicted the MMMA and was therefore not enforceable against qualifying medical marijuana patients.
Dont be surprised if the Michigan Legislature amends the MMMA outlaw the transportation of marijuana in a vehicle. This was still an important decision because the Court enforces the MMMA section 3 language which says that anything contrary is not effective.
